Terms of Service

Your account

You must provide accurate information, keep your credentials secure and are responsible for activity under your account and for the team members you invite. If you use 1Sygnal on behalf of a company, you confirm you can bind it to these terms.

Free trial

New accounts get a 14-day free trial with no credit card required. When the trial ends you need a paid plan to keep using the service. Nothing is charged before you choose a plan.

Plans, billing and renewal

• Subscriptions renew automatically. Paid plans are billed monthly or annually in advance and renew for the same period until you cancel. You authorise us and our payment processors to charge your payment method on each renewal.
• Currency and tax. Customers in Nigeria are billed in Naira, with VAT (currently 7.5%) added at checkout. Everyone else is billed in US dollars. Prices shown exclude taxes you are required to pay, which are added where applicable.
• Changing plans. You can upgrade, downgrade or switch between monthly and annual billing from the dashboard. If an upgrade payment fails, your account stays on its current plan.
• Cancelling. You can cancel from the dashboard at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Refunds. Except where the law requires otherwise, fees are non-refundable and we do not refund partial periods.
• Price changes. We will give at least 30 days' notice before a price change affects your renewal. A new price applies from your next renewal after the notice period.
• Failed payments. If a payment fails your account becomes past due, and we may retry the charge. While past due, the service keeps working. If the invoice is still unpaid, we may suspend the account: events are still received, but surveys are hidden and new responses are rejected until the invoice is paid.
• Invoices. Each successful payment produces an invoice and receipt. Amounts are payable without set-off, and you bear any withholding tax.

Acceptable use

You agree not to use the service to:

• phish, or collect passwords, payment card numbers, government IDs or other sensitive identity data from respondents;
• send unsolicited, deceptive or spam surveys, or manipulate or mislead respondents;
• distribute illegal, obscene, defamatory or infringing content;
• offer or promote prohibited or unlawful goods or services, or break any law, including collecting data without a lawful basis;
• hinder or disrupt the service, probe or reverse engineer it, or access it with unauthorised scripts, bots or scrapers;
• exceed your plan's limits or use the APIs other than as documented.

We may suspend or terminate accounts that breach this section, immediately in the case of serious breaches.

Your data and your end users

You own the surveys, responses and other data you put into 1Sygnal. You grant us the rights needed to host and process it to provide the service. 1Sygnal is a service provider: for data you collect from your end users, you are the controller and we are the processor under our Data Processing Agreement.

You are responsible for having a lawful basis, and any consent required by law, to collect that data through our SDKs, and for disclosing it in your own privacy policy and consent flows. You will not use the service to collect data in breach of law, and you will indemnify us against third-party claims arising from your failure to do so. See also our Privacy Policy.

AI features

AI features generate output from the content you provide. Output can be inaccurate or incomplete, is provided for your convenience, and must be reviewed by you before you rely on it or act on it. You are responsible for decisions based on it. We do not allow our AI provider to train on your data.

Availability and changes

We work to keep the service available but do not guarantee uninterrupted operation. We may update the service and these terms; we will tell you about material changes.

Termination

You can stop using the service at any time. We may suspend or end access for breach of these terms or non-payment. After termination you can export your data for 30 days, and we will delete it after that, except for invoices and financial records we must keep.

Warranty and liability

The service is provided "as is", without warranties of any kind, to the extent the law allows. We are not liable for any direct, indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits, revenue, data or goodwill, arising from your use of or inability to use the service, even if we were told they were possible. You use the service at your own risk. Nothing in these terms excludes liability that cannot be excluded by law, including liability for fraud.

If any exclusion of liability in these terms is found to be unenforceable, our total liability for all claims will not exceed the greater of (a) the fees you paid us in the 12 months before the claim and (b) ₦100,000 if you are billed in Naira, or US$100 if you are billed in any other currency.

Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. The parties will first try to resolve any dispute in good faith, and failing that the courts of Lagos State, Nigeria have exclusive jurisdiction, except that either party may seek urgent relief from any competent court.
